H.P. Hydraulique Inc, also having a division doing business under the name “Forcetech Consultant” (hereinafter collectively “H.P. Hydraulique” or “we”) is committed to protecting your privacy and your personal information.

This Privacy Policy describes H.P. Hydraulic’s privacy practices and the rights of individuals with respect to the collection, use, disclosure, retention, access, correction and deletion of personal information when you visit the www.hphydraulique.com website (hereinafter the “Website”) or communicate with us by any other technological means (telephone, e-mail, etc.).

WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, BY BROWSING THE WEBSITE OR BY PROVIDING PERSONAL INFORMATION TO H.P. HYDRAULIQUE, YOU CONSENT TO THE COLLECTION, USE, PROCESSING AND DISCLOSURE OF YOUR PERSONAL INFORMATION BY H.P. HYDRAULIQUE IN ACCORDANCE WITH THIS PRIVACY POLICY.

H.P. Hydraulique reserves the right to modify this Privacy Policy at any time and at its sole discretion. The date of the last update always appears in the upper left-hand corner of this Privacy Policy. Please check this Privacy Policy periodically for changes. If you continue to use this Website or to provide us with personal information after the date of any updates, you will be deemed to have accepted the updated version of this Privacy Policy.

Except as specifically provided in this Privacy Policy, the remaining terms of the “Terms of Use” accessible via the following link https://hphydraulique.com/conditions-dutilisation-site-web/ (the “Terms of Use”) continue to govern your and H.P. Hydraulique rights and obligations. All capitalized terms in this Privacy Policy have the meanings ascribed to them in the Terms of Use. This Privacy Policy and its interpretation, execution, validity and effect are subject to provincial and federal laws applicable in the province of Quebec, Canada, as applicable.

• Where? : Your personal information is held on our servers or those of our suppliers in Quebec, but some of our suppliers doing business outside Quebec may have access to your personal information.

• Your rights : you have the right to withdraw your consent and to request access to or rectification of your personal information held by us, subject to your legal or contractual obligations.

“Career” section. When you access the “Career” section of our website, you can submit an unsolicited application or apply for a specific job using the online form provided.

The following personal information is collected from candidates:

• Name ;
• First name ;
• Email address ;
• Phone number ;
• The job or job category you wish to apply for ;
• The personal information contained in the Curriculum Vitae (C.V.) you send us; and
• Any other personal information that you decide, on your own initiative, to disclose to us that is relevant to the job application.

Automatic collection. When you access the Website, our server automatically collects the following personal information:

• Your IP address ;
• The browser you use (Chrome, Microsoft Edge, Firefox, etc.) ;
• Your operating system (Windows, Mac OS, etc.) ;
• The domain name of your Internet service provider ;
• The date and time of your visit to the Website;
• The pages you visit on the Website; and
• The address of the website from which you access the Site.

Collection via cookies. Personal information may also be collected through the use of cookies. A cookie is a small data file stored on a Web Site visitor’s device by a Web site server. For more details, please refer to section 4 “Website browsing information” below.

In all cases, H.P. Hydraulique does not solicit personal information from children or minors under the age of fourteen (14) and refuses to contract with such persons.

Our Web site uses cookies administered by third parties, namely Meta, Google, YouTube and CookieBot. Some of these cookies will communicate Personal Information outside Quebec.

H.P. Hydraulique may share your personal information with third parties operating outside Quebec in the categories listed above. To this end, H.P. Hydraulique conducts a privacy impact assessment with each of these third parties and ensures at all times that when your information is communicated outside Quebec, it benefits from adequate protection, particularly with respect to generally recognized privacy principles.

When we collect personal information about you, we obtain your consent to use it for the purposes for which it was collected. H.P. Hydraulique requires your consent to use your information for other purposes or to collect additional information. For example, if express and specific consent is required, such as when sensitive personal information is involved, we will ask you for it.

You may withdraw your consent at any time, subject to your legal or contractual obligations, by submitting a written request to our Privacy Officer at the address indicated in section 14 of this Privacy Policy.

H.P. Hydraulique may retain your personal information for a period of time consistent with the original purpose for which it was collected. Once the purposes for which personal information was collected or used have been fulfilled, H.P. Hydraulique shall destroy or anonymize the information in order to use it for serious and legitimate purposes.

a. Right to withdraw your consent :

Subject to applicable law and contractual obligations, you may withdraw or change your consent to the use or disclosure of your personal information.

To do so, you may send a written request to our Privacy Officer at the address indicated in section 14 of this Privacy Policy. When submitting a withdrawal of consent, you will be asked to provide appropriate identification or otherwise identify yourself.

However, if you withdraw your consent to certain uses or disclosures of your personal information, we may no longer be able to provide you with certain products and/or services or the quality of our products and/or services may be affected. We will inform you of the consequences of your choice before accepting your request to withdraw consent.

b. Right of access and rectification :

You have the right to consult, rectify or update your personal information by submitting a written request to the Privacy Officer at the address indicated in section 14 of this Privacy Policy. In the event that a request is forwarded to H.P. Hydraulique, it will be dealt with promptly.

In addition, H.P. Hydraulique will inform you what personal information has been collected about you and will provide you with access to that information by sending you a copy, if applicable. In the event that H.P. Hydraulique is unable to provide access to certain personal information that has been collected, H.P. Hydraulique will inform you of the reasons why and the recourse available to it in such a case.

c. Right to portability :

In addition, as of September 22, 2024, you have the right to request a copy of your personal information in a structured and commonly used technological format, by submitting a written request to the Privacy Officer at the address indicated in section 14 of this Privacy Policy.

d. Right to be forgotten :

In some cases, you may ask us to restrict the dissemination of your personal information. Under this right, you can prevent us from disseminating your personal information, or ask us to de-index a hyperlink attached to your name allowing access to personal information, when the dissemination of this information (i) contravenes the law or a court order or (ii) causes serious harm to your right to respect for your reputation or privacy.

H.P. Hydraulic uses stringent security measures to protect personal information under its care and control against loss or theft, as well as unauthorized disclosure, copying, use, modification or access. The measures we take are physical, organizational and technological. Our employees are aware of the importance of maintaining the confidentiality of personal information.

When personal information is no longer required to fulfill the identified purposes, we take all necessary precautions to dispose of or destroy it in a manner that prevents unauthorized parties from gaining access to it. To this end, we monitor digital access to your personal information by logging the operations carried out on it.

We have established internal procedures to protect personal information and to receive and respond to your inquiries or complaints.

We deploy technical measures such as encryption, firewalls and malicious content detection software to protect personal information that has been collected, used or stored electronically. We also use strong passwords to access software or platforms containing personal information.

We ensure that each of our employees and representatives who have access to your personal information receives adequate training and vigilance with regard to privacy and the protection of personal information, and provide them with several monthly training sessions to ensure that this level of vigilance is maintained.

We limit access to your personal information to those employees who need such access in order to carry out one or more of the purposes listed in this Privacy Policy.

However, no method of transmission over the Internet, nor any means of electronic storage, is 100% secure. We therefore cannot ensure or warrant the security of any personal information you transmit to us.

There will always be risks associated with any disclosure of personal information. Nor can we guarantee that such information will not be accessed, obtained, disclosed, altered or destroyed as a result of a breach of our physical, technical or administrative safeguards.

Please note that any use of technology to identify, locate or profile you is disabled by default and such technology will only be enabled with your express consent, all as mentioned in section 4 of this Privacy Policy.

12. Confidentiality incidents

Confidentiality Incidents H.P. Hydraulique maintains a register of any known security incidents, as defined in the Act respecting the protection of personal information in the private sector (RLRQ, c. P-39.1), that may affect the security or confidentiality of your personal information. If an incident presents a risk of serious harm to you, H.P. Hydraulique will take the necessary steps to notify you, subject to applicable legislative provisions. The assessment of the risk of harm is based on the sensitivity of the information concerned, the apprehended consequences of its use and the likelihood that it will be used for harmful purposes.
